Per the provisions of 13:47A-3A.1 Registration of State registered investment adviser representatives, and N.J.S.A. 49:3-56(p), every individual applying for registration as an investment adviser representative must submit to being fingerprinted for a Criminal History Background Check. The State of New Jersey has contracted with a vendor, MorphoTrak, to perform this service.
Prior to contacting MorphoTrak, each applicant must complete the Certification and Authorization Form for a Criminal History Background Check (Authorization Form). A copy of the Authorization Form is attached to these instructions and can be found on the Bureau’s website at www.njsecurities.gov/njbos-8.pdf . The Authorization Form must be mailed to the Bureau at the address shown on the instructions. Once the Bureau receives the Authorization Form, a letter will be mailed or emailed to you with further instructions on how to schedule an appointment with MorphoTrak.
If the applicant is not located in New Jersey, the letter will provide further instructions on how to submit fingerprints to the Bureau.
If the investment adviser representative has already been fingerprinted by MorphoTrak after November 2003 as part of the criminal history background process for registration by the Bureau of Securities or the New Jersey Division of Consumer Affairs, the investment adviser representative need not be fingerprinted again. However, a criminal history background check must be performed each time an application for registration is submitted. The fee to update the criminal history background check is $22.55 regardless of where the individual is located. The update checks should be made payable to the State of New Jersey (see chart below).
